The proposal to amend the Personal Information Protection Act of 2011 (the “PIPA”) was approved by the South Korean National Assembly on February 27, 2023.
The changes cover a wide range of topics, from fines and breach of reporting requirements to transfer of data and business disclosure requirements.
Amendments to Korean Privacy Law
- The fusion of offline and online businesses’ data protection regulations;
- Changes to the provisions relating to administrative and criminal penalties;
- Lowering of the standards for processing personal information;
- Standards for processing special categories of personal information;
- The introduction of rights pertaining to automated decision-making; and
- New guidelines for cross-border data transfers.
