The proposal to amend the Personal Information Protection Act of 2011 (the “PIPA”) was approved by the South Korean National Assembly on February 27, 2023.

The changes cover a wide range of topics, from fines and breach of reporting requirements to transfer of data and business disclosure requirements.

Amendments to Korean Privacy Law

  1. The fusion of offline and online businesses’ data protection regulations;
  2. Changes to the provisions relating to administrative and criminal penalties;
  3. Lowering of the standards for processing personal information;
  4. Standards for processing special categories of personal information;
  5. The introduction of rights pertaining to automated decision-making; and
  6. New guidelines for cross-border data transfers.
